SHIPMENTS & RETURNS

Regarding product returns, the right of withdrawal is a special right that applies to distance sales.

 

You can exercise itonly if you are a "consumer" under the law and in accordance with the conditions set out below. According to the current legislation, a consumer is considered any natural person who acts for reasons that do not fall under his commercial, business, craft or independent professional activity. 
 

Buyer's Responsible Declaration: You expressly declare the following to us when completing your purchases and submitting your order:

If you buy from our e-shop and request the issuance of a retail receipt then it is assumed, for the purposes of fulfilling the right of withdrawal, that you are acting as a consumer, while if you purchase and request the issuance of an invoice then you are purchasing in the context of your professional activity and therefore cease to be a consumer and have no right of withdrawal hereunder (however the provisions of Articles 11 and 12 below shall still apply).

Conditions for exercising the right of withdrawal:As long as you make your purchases as a consumer, you have the right to withdraw from the sales contract without reason (i.e. without giving us an explanation) within a period of 14 days from the day of delivery of the products to you or to a third party with an express declaration of withdrawal you in the following ways: 

- By letter by post or courier at our headquarters, 
- Email commeilfautevents@gmail.com
- By filling in the declaration of withdrawal form that you will find here,

Deadline:You are entitled to exercise your right of withdrawal within 14 days and you then have another 7 days to return the products. In the event that you send the withdrawal form together with the product, this must be done (withdrawal and return) within 14 days from the day of delivery. The return must be made at your expense and responsibility to the company's headquarters. In accordance with the law, you must also bring the proof of exercise of the right of withdrawal and return of the product to our headquarters, as described below. In the case of a contract concerning several products ordered by you in one order and delivered separately, the 14-day period starts from when you or a third party (other than the carrier) whom you have indicated (e.g. in the case of a gift) acquires physical possession of the latter product.

Return Obligations 
In order to accept the return of a product, the following (cumulative) conditions apply:

 

A) You must have legally exercised your right of withdrawal within the prescribed time limits stated above, in the manner stated above and send the product(s) to the Company's registered office.
Please note that for hygiene reasons we do not accept returns of any product whose packaging has been opened, except metal products.
 

B) If you are returning a metal product, it must be in the condition it was received. Attention: you should handle each product you receive in the way that you would handle and examine it in a physical store, in order to determine its nature, characteristics and function and not to make any use beyond that. Therefore, with the exception of products that our store does not accept back for hygiene reasons, the product you return to us must: 
- If it has been opened, the original packaging must be intact, not worn or torn,
- Be complete, with all accessories and integral accessories in their original packaging,
- To be accompanied in the shipping package by all accompanying documents (proof of purchase, any warranty, instructions, etc.),
- In case this brought accessories or additional benefits, eg additional guarantees, to be accompanied by them as well.
 

Consequences of withdrawal
In the event that you legally withdraw, our Company will refund you, subject to the following paragraph, all the money received from you plus the cost of transport (but not any additional costs based on your options, e.g. cash on delivery) for the products that you returned, without undue delay, from the time we receive the products back. If more than one product is returned, then the money that will be returned will concern the product that was returned with the aforementioned procedure and conditions. The money will either be refunded to your card via the banking institution (if you paid by card) or deposited into the bank account you indicate to us (if you paid by any other payment method). For this reason, you should fill in the withdrawal form the IBAN number of the bank account to which you want us to deposit the funds from the withdrawal process. You are responsible for the correctness of your account information and the Company is not responsible for the case that the IBAN number you declared for the return is incorrect.

Impairment of product value

As long as you are returning a metal product whose packaging has been opened, in accordance with the conditions mentioned above, we reserve the right to examine the condition of the product and return it to you less the price for the use it has undergone. Our Company will calculate any depreciation of the product's value and will refund you the amount you paid for the purchase reduced by the aforementioned depreciation. The above legal right of the Company to set off based on the relevant table of impairment of value, constitutes the legal basis of the purchase and sale contract. 
In any case, regardless of the above right, each buyer may exercise his rights under the law or any commercial guarantee that accompanies the product as referred to in articles 9 and 10 below.
